NO KUDOS FOR the California legislature, which didn't deliver a
budget on time, refused to turn redistricting over to a panel of
judges and wasted valuable time seeking to loosen term limits.
Despite leaving numerous vital issues unresolved, legislators
somehow managed to find time to push through special interest issues
dear to their hearts. For example, Sen. Tom Torlakson, D-Antioch,
sought higher density development around transit stations by
expanding the definition of blight under California redevelopment
law and has now come up with another abhorrent bill. On Feb. 23,
2007, the senator introduced SB976, a 27-page bill titled "The
San Francisco Bay Area Water Emergency Transportation Response and
Disaster Recovery Act (WETA)," which would grant a new state
transportation agency authority and control overall public
transportation ferries and related water transportation services and
facilities within the Bay Area except for services and facilities
owned, operated and provided by the Golden Gate Bridge, Highway and
Transportation District.
The bill was championed by Sen. Don Perata, D-Oakland, who
carried legislation to remove California's Tidelands Trust law. That
allowed the Port of Oakland to sell 60 acres of public land on the
waterfront near Jack London Square, enabling Signature Properties
and Reynolds & Brown to develop a 2,000 unit mixed-use project.
The senator was a recent target of a federal corruption
investigation seeking evidence of illegal payments by companies or
persons directly to the senator or through an intermediary.
Should Gov. Arnold Schwarzenegger sign SB976, the 11-member San
Francisco Bay Area Water Authority (created by the Legislature in
1999) would be replaced by a five-member board; three of the
appointments being made by the governor, subject to confirmation by
the Senate, one by the Senate Committee on Rules and one by the
speaker of the Assembly.
The new state transportation agency, which would receive $250
million of the nearly $20 billion raised by infrastructure bonds
passed by voters in the November 2006 election, would have the
authority to plan, manage, operate, set fares, issue bonds, levy
special benefit assessments and borrow money. It alone would
determine the entry within its jurisdiction of any water
transportation service or facility that would affect public lands or
receive or benefit from the use of federal, state or local funds.
If you buy Sen. Torlakson's argument that, to provide security,
flexibility and mobility for disaster response and recovery in the
Bay Area, a bill which transcends any local interest and requires
that a single governmental entity assume ownership, operation and
management of existing ferry services, then you probably shouldn't
be surprised if confiscation of your home or business is next.
Perhaps someone should remind the senator that in November 2004
voters passed Proposition AA, a tax measure to protect public safety
and keep Bay Area traffic moving in the aftermath of an earthquake
or other disaster by authorizing BART to issue bonds not to exceed
$980 million to make earthquake-safety improvements in Contra Costa,
San Francisco and Alameda counties, including strengthening tunnels,
bridges, tracks and the underwater Transbay Tube.
