FEC sets fundraising cap on ballot measure
Agency lets individuals contribute up to $20,000 on redistricting
proposal.

WASHINGTON – Two San Joaquin Valley congressmen can raise cash in
$20,000 chunks to oppose a California redistricting ballot measure,
the Federal Election Commission ruled Friday.
The ruling frees Republican Reps. Devin Nunes of Visalia and
Kevin McCarthy of Bakersfield to divert hundreds of thousands of
dollars, or more, into the redistricting campaign. Redistricting
ballot measure supporters can do the same, meaning the redistricting
fight will soon get very expensive.
"I will be able to raise the money that's needed,"
Nunes said.
"Otherwise, I'm at a huge disadvantage compared to all the
other politicians in the state."
By a 5-0 vote, the FEC gave the congressmen some but not all of
what they wanted. Nunes and McCarthy had sought the authority to
raise money in unlimited amounts; instead, they can raise money
within certain limits.
"They can raise the funds for the ballot measure, up to
$20,000 from individuals," said George Smaragdis of the FEC.
Nunes and McCarthy are conservative allies who want to strip the
Democratic-controlled state Legislature of its redistricting power.
Every 10 years, following the census, the Legislature draws
Assembly, Senate and congressional lines that typically protect
incumbents.
In 2006, for instance, the nonpartisan Center for Governmental
Studies concluded that only six out of 153 California congressional
and legislative race were considered competitive.
In 2005, Nunes backed a previous effort that would have turned
redistricting over to a three-member panel of retired judges.
In that campaign, the Federal Election Commission likewise
determined members of Congress could raise money for the statewide
ballot measure.
Consequently, millions of dollars poured into the Proposition 77
campaign. The ballot measure failed, 60 percent to 40 percent.
Nunes and McCarthy originally hoped to raise money in support of
another redistricting ballot measure. In early December, Gov. Arnold
Schwarzenegger and the League of Women Voters backed a proposal for
an independent 14-person commission to draw state legislative
boundaries.
The proposal leaves out congressional districts.
"The governor is off in La-La Land, with his bogus reform
that doesn't include Congress," Nunes said, "so I'll be
raising the money needed to oppose their initiative."
To make sure they were playing by the rules, Nunes and McCarthy
asked the FEC whether they could raise unlimited "soft
money" funds for the Peoples Advocate Initiative Committee.
A 2002 campaign finance law blocks federal candidates and
officeholders from soliciting the unlimited funds for a federal
campaign.
"The threshold question is whether the funds are in
connection with an election for federal office," FEC Chairman
Robert D. Lenhard noted in an analysis.
Lenhard in his draft written opinion added that the congressional
solicitations may be "made only to individuals,"
suggesting that deep-pocketed companies, political action committees
and unions can't be solicited by the federal lawmakers. The money
can also be raised only for committees that aren't connected to a
federal office.
